Is Peru part of the Paris Convention? 

YES. Peru is part of the Paris Convention since April 11, 1995.

 

What is an industrial design? 

An industrial design is defined as the appearance of a particular product result of any meeting of lines or combination of colors or any two dimensional or three dimensional external shape, line, contour, configuration, texture or material, without changing the destination or purpose of that product. (ART 113 Decis. 486/2000, comisión C.A.)

 

What is required for a design to be registrable? 

For a design to be registrable as an industrial design, it is required to be new. It means that  before the application date has not been made available to the public by description, use or marketing. 


Designs whose appearance is necessary for the technical functioning of a product and which does not incorporate any arbitrary contribution of the designer are not be registrable .

 

How many designs can be registered in each application? 

Each registration has to relate to only to one industrial design. 

 

How long is the duration of the registration of industrial design? 

The validity of registration is 10 years from the filing of the application. It is not possible to renew registrations of a design.
