Requirements for a Registration E-mail

What information and documents are required to start the procedure?

The documents and information we need to file a new trademark application and to get a filing date and number are:

 

1.       Complete identification of the applicant:

  • Complete name or corporate name
  • Copy of identification document (if a natural person)
  • Complete address
  • Domicile (Country and City)
  • Telephone number and fax
  • E- mail address
  • If the applicant is a corporation  it needs same information about the legal representative.

 

2.       Six copies of the trademark specimens in a 6cm x 6 cm format. We also recommend you to send us the specimens as a .gif or .jpg file . The specimens have to correspond exactly to the trademark you want to register.   If colours are important in the mark design, you also need to send us the design in colour.

 

3.       A clear and complete indication of the products or services that you want to register and the category according to Nice International Classification (8th version). In Ecuador is required a detailed list of the products or services.

 

One application can only include  products or services in one class. If you want to register trademarks in different classes you need to file an application for each class.

 

The following documents can be filed in the next two months after the application. However, we recommend you to file the complete application from the beginning.

 

4. If the applicant is a corporation  it needs a  certificate of incorporation or an equivalent document.

This document has to indicate, a) that the corporation exists, b) that the corporation is running and c) that the person who grants the power has the legal capacity to grant it.

This certificate can be issue by a National entity of the country of the applicant, for example, the chamber of commerce or the public trade register.

 

5. The priority document issue by the competent entity, if it is claimed (in Spanish).

 

6. The power of attorney.

 

Documents have to be filed in spanish.  Documents in other languages have to be translated into spanish. 

 

Documents 4,5 and 6 have to comply with this formalities
