When does a trademark have to be renewed?
What is the renewal process like? How long does it take? What information and documents are required to start the procedure? When does a trademark have to be renewed? In Argentina a trademark is granted for 10 years from the registration date. Trademarks can be renewed indefinitely for periods of 10 years. Renewal petition has to be filed 60 days before the deadline. There are no extension of terms after expiration. If the petition is not filed during that period, the trademark is lost and a new application has to be filed. What is the renewal process like? The renewal process begins with the filing of a petition before the PTO. If the documents are in order the renewal is made. If there is a problem with the documents the PTO will issue an office action that has to be responded. How long does it take? The normal procedure lasts between 8 to 10 months. What information and documents are required to start the procedure? To start the procedure we require: 1. A complete identification of the applicant: a. Name or complete corporate name b. Complete address c. City and country d. Phone and fax number e. Email address f. If a corporation, the same information for the legal representative. 2. Clear renewal instructions. 3. Complete trademark identification (mark, class, file number, certificate number) 4. The power of attorney with signatures and charges (if a corporation) 5. Sworn statement of trademark use in Argentina in the last five years prior to expiration date. 6. If this is the first time the applicant conducts a trademark application with us, the power should be registered in the Argentinean Trademark Office. This registration is done once for each applicant. Documents 4 and 5 have to comply with this formality |
